Jean-Claude Mas learn his fate Tuesday

Criminal Court must give judgment Marseille on Tuesday at 10am in the case of breast implants.Jean-Claude Mas, the founder of the PIP company that manufactured these prostheses, will learn his fate. The prosecution had requested four years in prison for his arrest.
After the Commercial Court of Toulon which recognized the responsibility of TÜV certification in the case of defective prostheses, it is the turn of Marseille Criminal Justice to rule Tuesday on the responsibility of PIP leaders , including its founder, Jean -Claude Mas. 
This long-awaited decision in this case for "aggravated deception" and "fraud" , which mobilized from April 17 to May 17 more than 300 lawyers and nearly 400 victims in a room of over 4,000 m2 leased for circumstances, is only the first part of this criminal case drawers. Two other cases are still under investigation, one for "involuntary injury ", another for "fraudulent bankruptcy and money . "

Fraudulent gel

For a month, judges Marseille have studied the responsibility of five business executives in the use of a fraudulent gel for making breast implants. The prosecution requested four years in prison against Jean-Claude Mas, the founder of the Var company PIP, matching 100,000 euro fine  and a permanent ban on practicing in the medical and healthcare sector, and than managing a business. Lighter sentences of six months to two years, have been claimed against the other defendants.

More than 7,400 victims worldwide

Justice, which has accepted the civil party in this case to the requisitions were more than 7,400 reported casualties, approximately one-third of foreign, while more than 300,000 women are carriers of PIP implants in the world .

Another open file for "manslaughter and injuries"

Parallel to this first case handled by the preliminary prosecutor of Marseilles, a judicial investigation against X for " injury and manslaughter "  was opened in December 2011, after the death from cancer of a carrier in 2010 in the Gers . The instruction will be long, this part, informed by the Annaïck Le Goff JA, now comprising some 5,000 plaintiffs. The court of Aix-en-Provence appeal has ruled admissible the complaints of women who have not been out of their implants on the grounds of prejudice anxiety. M. Mas, his ex-CEO, Claude Couty, and three executives are indicted for " injury "and the status of assisted witness for the head of" manslaughter ".

A final issue for alleged fraud

Finally, another investigation was opened in May 2012 to track financial flows generated by the alleged fraud but also to investigate the heritage of factory management before and after the bankruptcy filing. M. Mas, his girlfriend and his ex-DG were also indicted in this component. 

The quality sentenced certicateur

Parallel criminal proceedings, counsel for the victims sought to recognize the responsibility of different stakeholders in this case - the German certification implants, TÜV , suppliers of PIP silicone or the National Security Agency of Health Products (MSNA , former AFSSAPS) - in civilian courts in France and abroad. A first victory has been achieved in mid-November by six distributors PIP products abroad and more than 1,600 carriers, including South American, who claimed more than 50 million compensation.

3000 euros per victim

The decision requires the group to provision 3,000 euros per victim, or 5.8 million total, pending individual expertise for each. TÜV and its French subsidiary appealed, but the decision is enforceable, the world's leading certification could be forced to pay. 
Abroad, procedures are also underway in Venezuela and Germany in particular. In general civil, they often seek surgeons and clinics, or as in Brazil, distributors PIP.
